The oft-used saying, “May you live in interesting times,” widely thought to be an ancient Chinese curse, was reportedly actually coined by a politician, Frederic R. Coudert, in 1939.  It seems apt in discussing the political and legal environment in which we find ourselves in today’s world of labor and employment law.  

Administrative agencies in the Biden Administration are in full swing of their efforts to move our employment laws in a manner that favors unions and employees, to the disadvantage of employers.  We are being inundated with laws on a state and federal level and new regulations from federal agencies; changes in the law on religious and pregnancy accommodation requests; and actual and proposed changes in the laws relating to employee handbooks, severance agreements, non-compete agreements, independent contractors, joint employer liability and medical marijuana.  What are best practices for compliance with all the new laws and regulations?  We will attempt to make sense of it all.

Bio:

Mike Malfitano is a senior labor attorney at the national labor and employment law firm, Constangy, Brooks, Smith & Prophete, LLP.   He assists employers in problem prevention and legal analysis of complex employment issues. He has represented employers in cases involving every aspect of the employment relationship. He also represents employers in collective bargaining, arbitration, and union avoidance. He counsels employers with respect to employee benefits issues, affirmative action, and in structuring payroll and compensation programs to avoid wage hour, as well as equal pay and discrimination issues.

Mike received a B.S. Degree from the School of Industrial and Labor Relations at Cornell University and a J.D. from Boston College Law School.  He has been recognized in Best Lawyers in America, Chambers USA, Martindale-Hubbell Preeminent Lawyers and Florida Super Lawyers. He is a past Chairman of the Labor and Employment Section of the Florida Bar and a past President of Mid-Florida SHRM.  He practices in Constangy’s Tampa and Lakeland Offices.
